    Default Pegasus SL/Hipo Campo Gea y Truyols, Murcia

    Hi, I am a newbie to this forum, but am a regular member of the Tenerife forum, as this is where we own property.

    I have joined this forum to ask if anyone has any information on property in Valle del sol.

    The reason I ask is that this is where my parents have "bought" property some 5/6 years ago. They are on the edge of the 3 molinos resort at Gea y Truyols. They developer they bought from at the time was Pegasus SL, headed by Lorenzo Garcia and his son Roberto. They are now trading as Hipo Campo, but have been told Lorenzo Garcia is bankrupt. They knew that it was illegally built at the time, but were promised that legalization would follow. There was no mortgage involved and it was a cash deal. My parents' home was one of six, who now find that their homes are built on land that is not owned by themselves as there is a debt on the land, of which the title has been returned to it's previous owner, a Rufino Calero. My parents, along with the other 5 owners, have been told that the debt on the land is to be repaid by Lorenzo Garcia, and that legalization will definitely follow. They are fighting reposession of the land in the courts, but are paying themselves for the subdivision of the plots, even though they do not own the land!

    I feel very suspicious of everyone involved, and am worried that they will be scammed out of further money.

    Does anyone have any information on this development or the people involved? My parents could be in line to lose everything they have worked for all their lives.

    Two pieces of advice. 1) Get a good solicitor. 2) Don't waste time. The sooner you act the better the outcome. Leave it too long and the fiscal trail grows gold, becomes more complex; this is expensive.
    The solicitor will get to the crux of the matter; identify possible solutions; proceed (or not) after you have had matters fully explained and risks assessed.
    Sorry but it is the only solution; the only sensible one. All is not lost - unless you allow it to lose itself. Good luck.

    Thanks for your reply. They do have a solicitor and are proceeding with it.

    I would still like to know if anyone knows of Lorenzo/Roberto Garcia.

    when you say the title has been returned to the previous owner,did the Gracias ever own the land?

    As far as I know, the Garcias "bought" the land from Rufino Calero on an installment agreement. They made some payments, but then defaulted on the remaining 600,000€. The original owner ( Calero ) then went to the court to have the land returned to him. This was granted by the court, but has not been executed, as the lawyer acting for my parents and the other 5 affected owners keeps getting a "stay of execution" to hold it off.

    Basically, they have "bought" illegally built villas, on land which they no longer own!! They have varying amounts of receipts for payments made, going from some receipts like my dad, to absolutely none for other owners.

    What I can't understand is, Lorenzo Garcia keeps saying he is going to clear the debt, but never does. Another story is that he is now bankrupt and everything is in his son's name. There is a connection to something in Jumilla, and I have been looking around on the internet, and have found "Pegasus Corporation Homes" registered there, which I suspect will be him.

    I really need some help here, as my dad appears to believe everything he is told, and I don't want him throwing more money at it, just to lose it all!

    pegasuscorporation.es seems to be a pretty slick site, But I can't find out who actually owns it.

    This is why I need so much help. I definitely smell a rat. I did turn up one director, but that was a woman, and I can't remember now how I found her.

    I am desperate to research this properly, then I can present all the facts to my dad before he makes a mistake again. I think he only asks the questions with the answers he wants to hear. He obviously does not want to hear that he's lost all his money. Maybe I am cynical, but I would have thought the lawyer would take the case on, even if he knows they won't win, because revenue is revenue, especially if you've just set up your own practice, as he has!

    so, your parents don't have a lawyer yet? might be a good idea to hire one quickly as Micheal suggested

    No sorry, they do have a lawyer, he is working for the 6 of them.

    What I meant was:- Would he have taken on the case, even though he knows they won't win, just because it's revenue for him?

    Be careful most lawyers in Spain are absolute scammers and not worth a cent. They will take you money, fill your ears with talk and never provide you with any successful handling of legal proceedings.
