    I fear that you haven't exactly told us what the point is!

    Do you feel that the moneys you have given to a charity have been diverted to the pockets of the organisers rather than the rightful beneficiaries of the charitable cause or there is an illegal operation in existence that constitutes fraud or theft? If so, then you should be taking it up with the Police, either directly or through your legal adviser.

    Of course you are fishing for tips on how to set up such an illegal "charity" then, I am afraid you have come to the wrong information source and should be getting your information from one of those crooked lawyers who are/were involved in the illegal property builds and scams.

    As stated you have to have a CIF No in oder to become a Charitable Association. The whole object of a CIF No is to ensure that your charity cause does NOT pay tax on their collections. Its not a way of avaoiding tax as the association must meet with certain criteria ie. must have audited accounts for inspection every 3 months if so warranted. You could fiddle the books but not advisable. Tin rattling of any description is prohibited in Spain although I rattle my tin on the PAD Sponsered walk but only whilst in possession of a licence to carry a collection tin. I personally do not place money in a tin [Poppy Appeal apart] but if I feel strongly enough about a charity like PAD for instance, I join the charity and am given regular updates on all aspect including the distribution of monies collected.

    Thank you for your response baldilocks but on this occasion I was looking for knowledge from someone who knew what they were talking about and not someone who has lived in Spain for a limited time and in a seemingly remote part. I know it is your want to comment on every post but on this occasion you would appear to be out of your depth. I resent the accusation that 'Of course you are fishing for tips on how to set up such an illegal "charity" which is totally unwarranted but perhaps gives an insite into your mindset.

    On the other hand keddyboy has some practical knowledge and I am grateful for his expertise. I would be interested to know the criteria he is audited against and indeed whether his organisation has ever been audited and who carried this out. As far as making allegations of fraud or theft goes, without legislation, Rules of Conduct, Codes of practice or anything else it would seem to be very difficult to prove either providing at least some money has gone to the cause. As he has stated there are extremely responsible organisations about who are happy to publish facts and figures. On the other hand there are some who won't/don't and as stated before there appears to be no mechanism to force them to do this.
