Renting out a property can be a minefield...I have heard many horror stories, such as people paying for a couple of months then moving out, taking everything, including sometimes the kitchen sink.. Others who stay for as long as possible without paying, then disappear a day or two before Court proceedings, to do the same somewhere else. I have a small apartment which I have rented to a friend in the UK.. He pays me by standing order in Sterling into my English account, and can come and go whenever he pleases. I don't charge him much, and although the sterling rate is not great at the moment, it is better than him having to fluctuate the cost depending on how the euro is doing each month. Also if the pound rises, I will gain, and he won't lose.

A good tenant that you know and look after, is worth two in an agency (or having an empty property.)

I agree with Greg's comments and advice. Desperate. You must start legal procedures to evict the tenants and also to claim the outstanding rent. If one of the tenants is working, you can request the embargo of part of her salary until the debt is paid.

On the other hand, for future rental contracts, please ensure that you request proper legal assistance from a qualified solicitor. The comments we have read about how the Spanish courts work are most of them correct, but you can avoid to get involved in such scenario by including an arbitration clause in your rental contract, which will help you to resolve your problems much quicker than through the courts.

I used to have four rental properties, but got so fed up with bad tenants that three years ago I sold them all.

The last two tenants I insisted on a Bank Guarantee for 12 months rent as part of the contract - never had problems with those two!

Now that the market is flooded with unsold empty property it has resulted in the rental market also being flooded with property with the result of reduced rent and poorer quality of tenant. At the moment, just leave them empty with no tenants - it will actually save you money and stress in the long run!
